Today we are anticipating amendments to HR 1, the 2011 Continuing Resolution that would completely eliminate the Land and Water Conservation Fund (LWCF)!

Before it’s too late, please weigh in with your Representatives and let them know that this is the wrong approach.  This program, which is FULLY PAID FOR by offshore oil and natural gas proceeds, has the support of millions of outdoor enthusiasts and provides incredible economic value to communities in every state. 

According to the Outdoor Industry Foundation, outdoor recreation, much of which takes place on LWCF lands, is vital to our nation's economy.  Hunting, fishing, camping, climbing, hiking, paddling, backcountry skiing, mountain biking, wildlife viewing, and other activities contribute a total of $730 billion annually to the economy, supporting 6.5 million jobs (1 of every 20 jobs in the U.S.)  With a fragile economic recovery beginning to take hold, now is not the time cut programs that add value to our communities.

A quick blurb:
&quot;Last year, KFTC brought hundreds of people to Frankfort to celebrate our love of the mountains and to rally in support of legislation to stop the dumping of mining wastes into streams and create a clean energy future for all Kentuckians.

We will continue this tradition in 2011 to keep pressure on our legislators and governor. On Monday, February 14 we hope to build on the unprecedented momentum we have against mountaintop removal and bring hundreds of people out to push legislators and Gov. After a five-hour meeting Friday, a Lexington Board of Adjustment hearing about Vulcan Materials Co.'s request for a conditional use permit was halted and extended until the board's next meeting.

Chairwoman Kathryn Moore called a halt at 6 p.m., saying some of the six board members who were present had other engagements and had to leave.

The first three hours of the meeting were devoted to hearing several other cases, including that of Embrace Church. The church was seeking a conditional use permit to purchase the Jefferson Fitness Center at 500 Maryland Avenue, off Jefferson Street, for a church. For two years, Embrace Church has met in the Kentucky Theatre on Sundays. Part of the church's ministry is serving the homeless.

A contingent of neighbors from the Near Northside Neighborhood turned out to oppose the church's request. &quot;My fear is the concentration of any more homeless to our area,&quot; said Rebecca Jann, whose family owns West Jefferson Place, an office building that backs up to the fitness center. Several others echoed her concerns.

The board voted 4-to-2 against allowing Embrace to move into the fitness center.

The Vulcan case took three hours. The company seeks permission to extend its underground limestone mining on Elk Lick Falls Road in southeastern Fayette County into 135 adjoining acres on Turner Station Road in the Old Richmond Road area.

For an hour, Vulcan's attorney, Richard Hopgood, explained why Vulcan should be allowed to expand. During the next hour and a half, geological and hydrological experts for Vulcan answered board members' questions.

Three neighborhood opponents — out of about 20 who signed up — had time to speak before Moore brought the meeting to a close.

The hearing will continue at 1 p.m. Feb. 11 in the Urban County Council chambers, if it is available. If it is not available, Moore said the case will be held over to the next regularly scheduled board meeting at 1 p.m. Feb. 25 in council chambers.

The board does not impose time limits on speakers, but it has discussed limits for several months, Moore said. At its February meeting, the board will vote on adopting time restraints.]]></description>

A rock quarry seeking approval to expand in southeastern Fayette County will face stiff opposition from neighbors when its request goes before the Urban County Board of Adjustment on Friday.

Vulcan Materials Co. is asking the board for a conditional use permit to extend its underground mining into an adjoining 135 acres along Turner Station Road in the Old Richmond Road area.

Neighbors oppose the expansion because of worries that more mining will increase air and water pollution and open more surface sinkholes in surrounding farmland.

Blasting causes damage to homes, and trucks cause trouble on the road, said Gloria Martin, a former member of the Urban County Council who owns a farm on Grimes Mill Road.

&quot;Generally speaking, their mining operation is a nuisance and poses a serious safety hazard, both from their blasting and their trucks,&quot; said Martin, who served on the committee that drafted Lexington's mining ordinance in 1991.

Old Richmond Road is a scenic highway driving route and a local historic area.

&quot;There's no way what they do is compatible with this area, and they should not be given permission to expand,&quot; she said.

Vulcan attorney Richard Hopgood said the company works hard to follow local, state and federal regulations.

&quot;We are highly regulated and we operate in compliance,&quot; Hopgood said.

Vulcan is asking for a permit to operate at a depth of about 300 feet on a portion of the 435-acre Hidden Haven farm on Turner Station Road.

Since 2000, the farm has been owned by Anderson Homes for Rent or developer Dennis Anderson. The company has mined and quarried limestone on Elk Lick Creek Road since 1958.

Vulcan wants to extend mining under part of Hidden Haven because further mining on its own property would mean going deeper, which would be more expensive, according to the Board of Adjustment staff report.

The report recommends approval of the conditional use permit, but only for about 50 acres of the 135 requested by Vulcan.

The report also recommends limiting Vulcan's blasting to no more than once a day and banning it from mining under Elk Lick Creek. Under the recommendation, the surface could not be disturbed except to construct air ventilators needed to comply with regulatory requirements.

Hopgood said blasting is done once a day at about 5 p.m.

&quot;We blast enough for the next day's production,&quot; he said.

Martin said shock waves can be felt up to two miles away.

&quot;Everybody out here has got cracks in their walls, in their foundations,&quot; she said. &quot;Vulcan's attitude is, 'You can't prove we did it.' &quot;

Rock that is crushed and stockpiled along Elk Lick Creek Road creates air pollution for those who live nearby, said Mary Diane Hanna, president of Old Richmond Road Neighborhood Association.

&quot;Dust turns the trees snowy white in that area,&quot; Hanna said.

Hopgood said the company uses an &quot;extensive amount of water&quot; to spray its stockpiles, conveyors and roads to reduce dust. &quot;We don't have any violations,&quot; he said.

Lexington's mining ordinance requires all trucks leaving the quarry to be covered, but not all are adequately covered, and some not at all, Hanna said.

Even covered, &quot;trucks barrel down the road,&quot; she said. &quot;Gravel flies off and has dented cars, cracked windshields. We've had gravel spills from overturned gravel trucks.&quot;

Hopgood said Vulcan refuses to load trucks that don't have adequate tarps.

&quot;We enforce the policy,&quot; he said. &quot;We log complaints. If somebody complains, we respond to it.&quot;

Hanna also said excess water trapped in the mine is pumped out, flowing onto the ground and into Elk Lick Creek, which flows into the Kentucky River.

Hopgood disputed Hanna's claim and said the company does not pollute the water.

Vulcan, based in Birmingham, Ala., is a publicly traded company with mines across the country that produce aggregates, primarily crushed stone, sand and gravel used in nearly all forms of construction.

The company also operates Central Rock on Manchester Street and mines under McConnell Springs.

This is not the first attempt by Vulcan to obtain permission to extend its underground mining onto the property on Turner Station Road. It tried unsuccessfully to get a similar permit in 1989 and 1998.

If anyone has any further specifics, please post them and links here.  This seems very concerning to me, since it involves one of the unmentionables and a favorite steep creek for those that have experienced it.

      <description><![CDATA[The US Forest Service has announced yet another 45 day comment period regarding paddling on the Upper Chattooga River, a form of outdoor recreation which they have banned on that section of river for 34 years.  Their announcement states that all comments since 2005 will be considered, and are only seeking any new comments, information, or ideas.

In late 2009 the USFS reached a new decision to ban paddling following at least 6 years of analysis. They almost immediately withdrew those decisions, cancelled their analysis, and scrapped all the pending appeals. Now, a full year later, they are trying to &quot;re-initiate&quot; that process. It is unclear what this means or what exactly the public is expected to comment on. The announcement sketches out their concept in broad terms that could reflect any amount of any use - from total bans to no limits whatsoever.

In an October 2010 court hearing, counsel for the USFS warned the court not to expect any outcome from this new USFS process except another boating ban. Thankfully, the court hearing was favorable for paddlers and the legality of any paddling ban - past, present, or future - will now undergo judicial scrutiny.

We encourage paddlers to read the USFS scoping letter, which includes directions for commenting, and offer any comments you may have by January 24, 2011.

&quot;In regard to Intervenors’ alternative argument that Plaintiffs’ Complaint should be dismissed
as it would apply to the section of the river flowing through Intervenors’ property, the court also
declines to dismiss the Complaint on this basis. Plaintiffs conceded that they seek no injunctive
relief which will affect Intervenors’ private property adjacent to the river. However, both parties
vigorously dispute whether the property over which the river actually flows is private property. The
dispute turns on the determination of navigability. The Supreme Court has held that navigability
“involve[s] questions of law inseparable from the particular facts to which they are applied,” and
navigability of a particular river “is, of course, a factual question.” United States v. Appalachian
Electric Power Co., 311 U.S. 377, 404-05 (1940); see also New York State Dept. of Envtl.
Conservation v. Fed. Energy Reg. Comm’n, 954 F.2d 56, 60 (2nd Cir. 1992).

      <title>KFTC Action Alert: Want to stop the next valley fill?</title>

A proposal by the U.S. EPA to adopt new water quality standards for conductivity could go a long way in stopping mountaintop removal and valley fills and cleaning up streams in Central Appalachia. But the EPA is still deciding whether or not to make those standards permanent. You can help convince federal authorities that those standards are absolutely essential for protecting water quality in communities where coal is mined.

 EPA is accepting pubic comment on the proposal standards until December 1. Please take one of the following actions:

1) Submit your own comments to EPA supporting their proposed stream conductivity standards. The background information provided below describes the proposed standards and science to support them. Writing your own comments will get more notice from EPA.  You can submit comments to the EPA by sending an email to OW-Docket@epa.gov with &quot;Docket ID No. EPA-HQ-OW-2010-0315&quot; in the subject line.

2) If this is not something you can do, please sign on to letter to EPA Administrator Lisa Jackson at ilovemountains.org. You can modify this letter if you’d like, so sign on to it as is.

Thanks for taking action. These are the standards that the coal industry and Gov. Beshear have sued to halt, so we know they have the potential for ending most stream pollution resulting from mountaintop removal and valley fills.

What is water conductivity?

Conductivity is a general indicator of the pollution in a stream – it reveals the concentration of salts or metals. The natural conductivity of central Appalachian streams is about 250 micro Siemens. So that means plants and animals have adapted to live in streams of a conductivity around 250 micro Siemens. When the conductivity rises above 500 micro Siemens lots of living things in the streams begin to die. The conductivity below surface mines tends to be between 900 and 3,000 micro Siemens.]]></description>

      <description><![CDATA[All, I wanted to share with you this email yesterday that I received related to the meeting last Friday, coordinated by Doug Davis, and well attended, with very interested Frankfort folks that care about developing eco-tourism such as paddle sports.  I thought this meeting was fruitful and has potential if everyone is serious about focusing on Kentucky's natural eco-tourism potential such as paddling, climbing, biking, hiking, etc.

First of all the Kentucky Sports Authority and the Office of Adventure Tourism would like to take the time to thank everyone for their participation in last Friday’s meeting, and their continued interests and efforts surrounding this initiative!! Attached please find the notes from our meeting as promised. We will be diligently working towards our next steps as outlined in the attached document and are looking forward to the opportunity of continuing to work with everyone moving forward.       <title>Town Branch Trail public meeting December 6</title>

      <description><![CDATA[For those of you interested in trails, there will be a Town Branch Trail public meeting to present alternatives for continued development of this shared use trail which will connect downtown Lexington to Masterson Station Park.

The meeting is from 6 to 8 pm, Monday, December 6.

It is important that people show up and show their enthusiasm for this project. The trail will be creekside for part of its alignment. The more that people can see the creek, the more political will there will be to clean up this main tributary to our Mighty Elkhorn. Plus, this trail will link several interesting historic and natural features, and just be a fun place for a low-key walk, jog or bike ride.

Unfortunately, I have a prior commitment and can't be there myself, but I'm hoping some of y'all can go.

And please pass this info along to anyone you think may be interested.

Two big things immediately jumped out at me.

Negative. Ive got the past ten plus years of research on accident prevention, chaos theory, risk assessment and management, and other resources which would argue vehemently against that statement. I would suggest they read Jame Gleick's 'Chaos' and Scott Sagan's ' The Limits of Safety' and Laurence Gonzales' 'Deep Survival'. 

&quot;First aid and CPR shall be offered at the discretion of the supervisor in
consultation with willing employees.&quot;
That's not mandatory for all park service employees? Im surprised that many different commercial and industrial businesses here in Louisville contract with the local Red Cross chapter to teach their employees CPR and first aid and require it, but the NPS would not.]]></description>
